1. About LuxeVault

LuxeVault ("we," "us," or "our") operates as a curated commission-based marketplace — not a reseller, retailer, or dealer. We connect consumers with authenticated luxury manufacturers and independent designers who sell and ship products directly to customers.

Important: LuxeVault does not purchase, hold, warehouse, or take title to any product listed on this platform. All products displayed are offered for sale by the respective manufacturer or brand partner ("Manufacturer"). LuxeVault facilitates the transaction and earns a commission; the Manufacturer fulfills the order and handles all post-sale responsibilities.

By using LuxeVault, you acknowledge and agree that your purchase is made directly from the Manufacturer through LuxeVault as a marketplace intermediary.

2. Acceptance of Terms

By accessing or using LuxeVault (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date above. Continued use of the Service after changes constitutes acceptance.

3. Product Warranties & Customer Service

Products shown are sold by the applicable Manufacturer through LuxeVault. All warranties and returns are handled directly by the manufacturer. LuxeVault does not sell, warrant, or service products. Pricing reflects manufacturer MSRP and may change without notice.

Manufacturer Responsibility

All product warranties, guarantees, and return policies are managed directly by the respective Manufacturer. Specifically:

LuxeVault does not sell, warrant, or service any product listed on this platform.
Customers must direct all questions about product quality, defects, shipping damage, or returns to the applicable Manufacturer using the contact information provided in your order confirmation.
The Manufacturer maintains sole authority over return decisions, warranty claims, and refunds.
LuxeVault will facilitate communication between you and the Manufacturer within 24 hours if you contact us directly.

What LuxeVault Does

Connects you with curated, verified luxury brands and manufacturers.
Authenticates all partner manufacturers and designers prior to listing.
Facilitates the purchase transaction and payment processing.
Helps you contact the manufacturer within 24 hours if issues arise.

Returns Process

Contact the Manufacturer directly (link and contact info provided in your order confirmation email).
Follow the Manufacturer's return shipping instructions.
Refunds are processed by the Manufacturer, typically within 7–14 days of receipt of returned goods.

Authenticity Guarantee

LuxeVault partners exclusively with authorized manufacturers who have provided written verification of authenticity. If you receive a counterfeit or unauthorized product, contact us immediately at luxevault@polsia.app with proof. We will escalate to the Manufacturer and work toward a full refund.

4. Pricing and Payment

All prices displayed on LuxeVault reflect manufacturer MSRP (Manufacturer's Suggested Retail Price) and may change without notice. Prices are displayed in U.S. Dollars unless otherwise stated.

Payment is processed securely via Stripe. By placing an order, you authorize us to charge the payment method provided. LuxeVault does not store complete payment card information.

Applicable taxes, duties, and shipping costs are calculated at checkout. International orders may be subject to customs fees, which are the buyer's responsibility.

5. Orders and Fulfillment

When you place an order on LuxeVault, your order is forwarded to the applicable Manufacturer for direct fulfillment. LuxeVault does not ship or handle any physical goods.

Delivery timelines are determined by the Manufacturer and the shipping carrier. LuxeVault makes no guarantee regarding delivery dates. Estimated shipping timelines, when displayed, are provided by the Manufacturer and are not contractual commitments.

If a product becomes unavailable after your order is placed, LuxeVault will notify you and process a full refund to your original payment method.

6. User Conduct

You agree not to use LuxeVault for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited activities include:

Submitting false, fraudulent, or misleading information.
Attempting to gain unauthorized access to any portion of the Service.
Interfering with other users' use of the Service.
Using automated tools to scrape, crawl, or extract data without prior written consent.

7. Intellectual Property

All content on LuxeVault — including text, design, layout, graphics, and the LuxeVault brand — is owned by or licensed to LuxeVault and is protected by applicable intellectual property laws.

Product images, descriptions, and brand names belong to the respective Manufacturers and are used with authorization. Unauthorized reproduction, redistribution, or commercial use is prohibited.

8. Limitation of Liability

To the maximum extent permitted by applicable law, LuxeVault and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use of, or inability to use, the Service.
Any product purchased through the Service, including defects, damage, or non-delivery.
Any Manufacturer's failure to fulfill an order or honor a warranty.
Unauthorized access to or alteration of your data.

In no event shall LuxeVault's total liability to you exceed the total amount paid by you for the specific order giving rise to the claim.

LuxeVault expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to third-party products.

9. Indemnification

You agree to indemnify, defend, and hold harmless LuxeVault from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to the following process:

Negotiation (30 days): First, contact us at luxevault@polsia.app to attempt an informal resolution.
Mediation (45 days): If negotiation fails, both parties agree to attempt mediation before a neutral mediator.
Binding Arbitration: If mediation fails, disputes shall be resolved by binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.

You agree to waive any right to participate in a class action lawsuit against LuxeVault. Any arbitration shall be conducted on an individual basis.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Delaware.

12. Privacy

Your use of LuxeVault is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Modifications and Termination

LuxeVault reserves the right to modify or discontinue the Service at any time without notice. We may also terminate or suspend your access for violation of these Terms. Obligations and liabilities incurred prior to termination shall survive.
